Traffic stop nets small amount of cocaine

The failure by an Atlanta man May 6 to stop at a stop sign at White Road and Heritage Lake Drive resulted in drug charges for three grams of cocaine and less than an ounce of marijuana.

Justin J. Shealy, 20, was charged with failure to stop at a stop sign, less than an ounce of marijuana and possession of cocaine with intent to distribute for the three grams of suspected cocaine in two small bags found in his center console, said Fayetteville Police spokesperson Steve Crawshaw.

Crawshaw said that after detaining Shealy officers noticed him moving around in the back seat of the police car. After finding a small amount of suspected marijuana scattered in the police car, officers proceeded to search Shealy’s vehicle, Crawshaw said.

A small amount of marijuana was found on one of the passengers, 17-year-old Fayetteville resident Janae D. Weaver, said Crawshaw. Both Weaver and 17-year-old Fayetteville resident Aryn E. Collins were charged with possession of cocaine, though the drug was not found on them, Crawshaw added.

I read this story and I'm trying to figure out how the conclusion is come to that three grams makes some one a "cocaine distributor" Someone clue me in, I feel stupid???

If fact, no amount of cocaine makes it "distribution" worthy. There'd have to be circumstantial evidence demonstrating an intent to distribute (scales, unique packaging, large amounts of money).

3 grams is commonly known as an "8-ball" (it's approximately 1/8th of an ounce), and pretty common for a solo night of heavy partying.

EDIT: I assume the charge is going to be based on having it packaged in two bags, which is, of course, absurd.

Well I guessed that it was because it was in two bags.
