PTC settles with mayor; restores salary and $2K back pay

It cost the Peachtree City Council $2,025 to refund Mayor Don Haddix his back pay Thursday night as part of a settlement agreement to avoid a lawsuit over the unprecedented pay cut council enacted on Haddix in May.

The agreement also calls for Haddix’s pay for this fiscal year to be fully restored, and the city did not have to pay Haddix any attorney’s fees as a result.

The settlement action was taken to avoid a potential lawsuit that could have put the city on the hook for “up to six figures” if the city had lost, according to Mayor Pro Tem Kim Learnard.

The settlement agreement was approved by council on a 4-0 vote and does not require the city to reimburse Haddix for attorney’s fees. Council also approved payment for its outside counsel in the case, Laurel Henderson, as city attorney Ted Meeker was a potential witness in the case and could not represent the city at any point in the matter.

Haddix abstained from the vote and discussion on the settlement, but voted against the payment for Henderson’s services on principle.

In May, council voted to cut Haddix’s pay from $750 a month to just under $75 a month, and they continued that pay cut by making it a part of this year’s city budget. The pay cuts were a reaction to recoup nearly $10,000 in legal fees the city paid to litigate and settle a libel lawsuit filed against Haddix by former Mayor Harold Logsdon.

Haddix’s attorney has contended that council had no authority to cut the mayor’s pay in mid-term because city rules require any pay changes to be effective on the subsequent term of office.

The issue of the city paying for Haddix’s legal fees in the libel case was brought about because the risk management agency was convinced to cover the cost of the legal charges and settlement after the case concluded. The agency ruled that since the alleged libelous statement was contained in an email Haddix sent to a city employee, it was an official act Haddix undertook as mayor.

Others contend that Haddix’s labeling of former Mayor Harold Logsdon as “part-drunk” at council meetings was a personal cheap shot and not one deriving from his official duties.

As for the subsequent lawsuit considered by Haddix, the city’s risk management agency denied coverage for the city and the four council members.

There is actually plenty of precedence legally that just because you use a government email account to say something that in no way makes it an "official act" or anything else legally. This wasn't the time or place to fight this and glad to see Council go 4-0 in giving this little pathetic guy with the huge mouth and small brain his 2K back and now the voters we'll take care of his sorry carcass a year from now.

Council if they had never started this foolishness. If you think Haddix has a big ego, you haven't seen anything else--just watch Imker.

that is for sure. Worst Council I have ever seen in PTC.

I had said before last election I was hoping for Imker to get a strong challenger. Instead, we got a Haddix flunky that got beat rather handily by blowhard Imker. That's too bad for PTC because Imker is about as bad as Haddix.

Went to Corelli's the other night and BIG THUMBS UP! The place isn't great on the inside as it's obvious they just moved in, but the FOOD is everything it should be and then some!

Wife did....it's the dessert that is made from some of the same stuff the garlic knots are and she raved about it. Every bit as good as the "old" Corelli's and will definitely be returning there.

Maybe he can reinvent himself and come back a few years later. Worked for Steve Brown. Almost worked for Mitt Romney.

There has existed some FC elected officials I actually liked and voted for! Imagine that...competent people that did a competent job, unlike your idol Haddix that brought all of this BS on himself and pretty much begged for it since he's an attention whore with a Napoleonic complex that you actually applaud.

You want theater and crap and I want professional governance of my tax dollars without hysterics and without our elected officials acting like they are in grade school. That includes a lot more people than just Haddix. We'll never see eye-to-eye on much in this area I guess.

Putting this little distraction about stealing $11 large from the city behind him now, the dork could actually get reelected, as Presbo did. Not about records or failure or anything like that - instead it is about hearing the hope and change crap and pushing the right button. Right? Right?

Council was trying to serve the best interests of citizens, but, in the end, it was best to settle then pour more taxpaper money into the situation.

No matter what GIRMA says, the citizens of Peachtree City were "fleeced" by the mayor's poor judgement.

Peachtree City has suffered now for 3 years due to his poor judgements, inability to show leadership to build the coalition within the PTC government to really move the city forward.

Hopefully in 2013, we can elect someone who can do the job.

We could all forgive a mistake in judgement.
He could have simply appologized
But the stubborn man fought it and lost in court.

What chaps my butt is that he hid his fight with GIRMA from council. Then, once his attorney finally sent them all the papers for GIRMA to make an informed decision and they agreed to pay, he tried to hide the costs until it was caught during a city council meeting.

That showed me his true character. I will hereby contribute to the best candidate that runs against this man.

Haddix, Learnard, Fleisch and Imker like beating each other over the head with sledge hammers. They are pathetic. Replace the lot of them!

Kim Learnard needs to run for the school board. Maybe her ego won't clash so badly with the newbies over there.

Time to find some grownups who can work together. I remember when I used to work at Fayette State Bank a long time ago there was big spat going on with some of the original power brokers. It turned out they neutralized each other and that allowed the new dogs to take control. We'll see what happens here.

Amen. I don't think the typical PTC resident expects miracles or greatness from our elected officials, but staying out of the news, NOT creating news and simply carrying on the business of the city without all the damn drama isn't too much to ask for.

what's found in all the bickering back and forth. The truth of the matter is that this problem should have never been created in the first place. City Attorney Ted Meeker never should have written the letters on behalf of Haddix without consulting the full counsel first and preferably the counsel would have voted on the issue. It was Meeker who kept on the Risk Management Agency to pay. When they decided to stop fighting the city is when the problem started since the city had to pay the deductible. It was "pay it and we will pay you back because those are the terms of our policy". It was the only way for Haddix to get his legal fees paid without it being approved by the council. He is scum for going this route and he needs to go. Ted Meeker was complicit in Haddix's shady conduct, is lacking as an attorney and he also needs to go. And for such an amazing display in lack of leadership and how the full council handled the issue from the beginning they all need to go as well..even if they did redeem themselves a bit in the end for going ahead and settling instead of dragging the city into a 6 figure lawsuit. I just want to know how much was paid to outside council, how much is it 3K, 5K, 10K or more? The people will want to know how many more thousands of dollars their "leaders" threw away in this futile attempt to recover about 10 grand.
